Evictions
In spite of your best efforts, the reality is that every now and then, you’re going to run into trouble with your tenants. Even good tenants go bad.
Every state has its own landlord-tenant law that provides basic guidelines. There’s a basic tenant that they all follow, but they all have interpreted things differently. There’s a difference, I can tell you, Florida is a very owner-friendly state, and New York is a very tenant-friendly state, and some states may be a surprise to you. Pennsylvania is actually more owner-friendly than Virginia, and you would think, maybe, on the surface, that it might be the other way around, but that’s not true.
You have to study and understand your particular landlord-tenant law in your state as it relates to evictions. I’m going to give you some basic guidelines that you can follow, and then just like we did with the rules related to escrow, you can basically just look those up, and find out what your rules are for your LT, what we call landlord-tenant cases.
You can also visit your local magistrate’s office, or simply call them, and ask them if they can mail you their process to file a landlord-tenant complaint against a tenant. Sometimes they’re online, but oftentimes they’ll just say to stop in and pick them up, because they’re not in the business to meet your needs. They’re in business to dispense law.
